TICKETING TERMS OF SALE AND PURCHASING CONDITIONS (29 May 2024)
The Sydney Fringe Incorporated (ABN 16 393 987 277)

TERMS OF SALE. Please read these Terms of Sale prior to purchasing a ticket for any event presented in the Sydney Fringe Festival program, or that is arranged by the Sydney Fringe, or for which the Sydney Fringe sells tickets. 
 
By purchasing a ticket to a Sydney Fringe event, you represent that you have read and understand these Terms of Sale and Purchasing Conditions, and any additional terms and conditions imposed by Ferve (ticketing services agency) and displayed to you during the booking process. 
 
By purchasing a ticket on behalf of someone else, you undertake to inform them of these Terms of Sale and Purchasing Conditions and any other terms and conditions imposed by Ferve (ticketing services agency) and displayed to you during the booking process. 
 
“Event” means a concert, show or other performance during the Sydney Fringe Festival or that is arranged by the Sydney Fringe, or for which the Sydney Fringe sells tickets. “You” means the person acquiring a ticket or seeking to attend an Event and “We” means The Sydney Fringe. 
 

  1. Ticket Validity. Tickets at Sydney Fringe Festival are only valid if purchased through The Sydney Fringe (via the telephone, www.sydneyfringe.com, or at a Sydney Fringe Box Office) or an authorised agent. 
  1. Booking Fee. A booking fee of $2.50 (GST inclusive) will apply to your ticket purchase upon completion. This booking fee is applied per transaction, not per ticket.  
  1. Merchant Fee. All transactions will incur variable non-refundable credit card charge by the Merchant facilityArtspay 
  1. Payment. The Sydney Fringe accepts Mastercard, Visa and Amex for transactions made online and over the phone. Sydney Fringe Box Offices accept Mastercard and Visa only. Cash is not accepted as payment for tickets at any point of sale. 
  1. Refunds. Ticket purchases cannot be refunded except in circumstances outlined in the Live Performance Australia (LPA) Ticketing Code of Practice, including event cancellations, event re-scheduling, or a significant change in the events location. Changes in personal circumstance or personal enjoyment of an event does not entitle a ticket holder to a refund Before purchasing tickets, carefully review the event date and time details.  
  1. Exchanges. Ticketholders are eligible for an exchange of their ticket(s) to a different performance in the production season of their originally purchased production. Exchanges can be made via the Sydney Fringe website or can be requested via email to boxoffice@sydneyfringe.com Email requests and web exchanges must be finalised 72 hours prior to the performance and will be subject to availability and price differentials. An exchange fee of $3 per ticket applies to all ticket exchanges, plus merchant fees 
  1. Cancellation. If an Event is cancelled, ticket purchasers are entitled to a refund. Further details of ticket options will be provided upon notice of Event cancellation. Any refund will be made to the original method of payment.  
  1. Lost and Stolen Tickets. The Sydney Fringe reserves the right not to process a refund or offer an exchange for lost or stolen tickets. It is the responsibility of the purchaser to supply an accurate email address for delivery, and to contact the Sydney Fringe if tickets do not arrive as outlined in these terms.  
  1. Seating. For fixed-seated events, The Sydney Fringe holds the right to allocate you to a different seat for operational reasons, including a change of venue or stage restrictions. In these circumstances, the Sydney Fringe will endeavour to re-allocate you to a seat of comparable value to your original purchase  
  1. Pricing. The Sydney Fringe may, without notice, alter the price of tickets to match the demands of consumers. Tickets purchased prior to a price alteration are held to the Terms and Conditions at the time of purchase and will not entitle you to a refund for the value of the ticket or the difference between the two price points.  
  1. Concessions Holders. Valid concession card holders are eligible for concession price tickets, where available. Eligible concessions are for: Full Time Students, Pensioners, Seniors, Health Care Card holders, Veterans, and the Unemployed. Valid proof of concession may be asked for when purchasing tickets or upon venue entry.  
  1. Delivery Method. Tickets for the Sydney Fringe will be available in the Sydney Fringe app and emailed to you upon purchase and re-sent 24 hours prior to each event for your convenience. Please ensure that you have checked your spam folder if you have not received tickets to your inbox 
  1. E-Tickets.  Tickets purchased at the Sydney Fringe will be issued as E-Tickets. Please ensure you have a valid email address to access your tickets and check all spam and promotions folders if you are unable to locate your tickets in your inbox. Tickets can also be located via your login at www.sydneyfringe.com or the Sydney Fringe app. If you are unable to locate your tickets, please reach out to boxoffice@sydneyfringe.com. 
  1. Ticket Resale and Authorised Platforms. The Sydney Fringe does not have an authorised resale platform for tickets and only tickets purchased via The Sydney Fringe should be considered valid. Tickets purchased via unauthorised resellers including Viagogo, eBay, and Gumtree may be fake. The Sydney Fringe may engage third party agencies to onsell valid tickets, including ShowFilmFirst and TodayTix. If you are unsure if a sale platform is genuine, please reach out to boxoffice@sydneyfringe.com. 
  1. Promotional Use of Tickets. Tickets may not, without prior written consent from The Sydney Fringe, be offered as a prize or used for advertising or other promotional use. 
  1. Venue Conditions of Entry and Latecomer Policy 
  1. Admittance to the Event will be subject to the policies of the Venue hosting the Event. 
  1. The performance will strive to begin at the advertised time. Late arrival may result in non-admission to the Event, or forfeiture of your original purchased seat. 
  1. The Sydney Fringe will not provide a refund for the purchased tickets if you are refused entry to a venue, if you are late, or for any other reason prohibiting your on-time attendance. 
  1. By purchasing a ticket or attending a Sydney Fringe event, ticketholders acknowledge that the Sydney Fringe, or its Partners, may be photographedrecorded and/or filmed for material to be used for the Sydney Fringe or its Partners ongoing purposes (including but not limited to, promotional (including social media), marketing, archival purposes and annual reports). The Sydney Fringe retains the ownership of all imagery material. 
  1. The use of recording or photographic devices by the ticketholder is not permitted, and mobile devices must be switched to silent or off prior to the beginning of the performance. The use of professional cameras, video cameras and other recording devices is strictly not permitted. 
  1. Entry may be refused if tickets are damaged or defaced beyond legibility or are not purchased from the Sydney Fringe or other authorised sellers 
  1. Other conditions of entry may be displayed at the entrance to the venue and should be followed accordingly.  
  1. Show Content and Classification. Unless a performance is categorised as a children's or family show, content may not be suitable for all ages. Event classifications are available on the web page for each event at www.sydneyfringe.com, and you can contact boxoffice@sydneyfringe.com prior to your purchase to check suitability. By purchasing your tickets, you acknowledge that you and your attendees are the minimum age requirement for this performance and that you may be refused entry if you are unable to provide proof of age.  

  1. ContentSydney Fringe is an open access festival, in which works are created solely by independent artists with limited curatorial input from Sydney Fringe. Views and/or political affiliations expressed by artists are not necessarily reflective of those shared by the Sydney Fringe and its staff 
  1. Under 18. Please note, some venues may have liquor licensing requirements in place that does not allow under 18’s entry to the venue or allowed past a certain time. If unsure you are advised to contact the venue for the most up to date information. 
  1. Program Details. Every effort is made to ensure program details are correct, however program details are subject to change where necessary and without notice. The Sydney Fringe Festival website (www.sydneyfringe.com) will provide the most up to date listing of event information. 
  1. Revisions to Advertised Program. The right is reserved by the Sydney Fringe to add, withdraw or substitute artists, performers or events, vary ticket prices, and/or vary advertised programmes, seating arrangements and audience capacity. 
  1. Privacy Policy. By purchasing a ticket, attending an event or otherwise dealing with Sydney Fringe, you agree to be bound by the Sydney Fringe Privacy policy.  A copy of the privacy policy can be viewed at www.sydneyfringe.com  
  1. Liability. The Sydney Fringe will not be responsible or liable for any loss, damage or injury to the extent arising from your negligent acts or omissions, any pre-existing medical condition, your breach of these terms and conditions, or your reliance on reviews and opinions about Events and performers. You should make your own further inquiries before deciding whether an Event is suitable. You are responsible for your personal possessions such as bags, mobile phones and other items you carry with you. Our liability to you in relation to tickets is limited to the obligations specified in these Terms of Sales and Purchasing Conditions. 
  1. Modification and Amendment. We have the right, at any time and without notice, to add to or modify the terms of the Term of Sale and Purchasing Conditions, by posting such amended terms on our website. Your access to or use of the website after the date such amended terms are delivered to you shall be deemed to constitute acceptance of such amended terms. No modification made by you shall be binding upon Sydney Fringe unless it is made in writing and signed by the Sydney Fringe. 
  1. Force Majeure. If the performance of any part of the Terms of Sale and Purchasing Conditions by either party is prevented, hindered, delayed or otherwise made impracticable by reason of any flood, riot, fire, judicial or governmental action, labor disputes, act of God or any other causes beyond the control of either party, that party shall be excused to the extent that it is prevented, hindered, or delayed by such causes. 
  1. Severability. If a clause or part of a clause can be read in a way that makes it illegal, unenforceable or invalid, but can also be read in a way that makes it legal, enforceable and valid, it must be read in the latter way. If any clause or part of a clause is illegal, unenforceable or invalid, that clause or part is to be treated as removed from these terms, but the rest of the Terms of Sales and Purchasing Conditions is not affected. 
  1. Governing Law and Forum. The Terms of Sales and Purchasing Conditions are governed by and must be interpreted in accordance with the laws of New South Wales. The parties must unconditionally submit to the non-exclusive jurisdiction of the courts of New South Wales. 
  1. Goods and Services Tax. A party must pay GST on a taxable supply made to it under this Agreement, in addition to any consideration (excluding GST) that is payable for that taxable supply. The party making the taxable supply must provide a valid tax invoice to the other party at the time that the other party is required to pay the GST. Terms used in this clause have the meaning given to them in the A New Tax System (Goods and Services Tax) Act 1999. 
  1. Exclusions. These terms apply to events sold through sydneyfringe.com via the Ferve tickets platform and transacted via the ArtsPay merchant facility.

'Ferve Tickets' (Ferve Tickets Pty Ltd ABN 41 074 903 085) operates a system for event ticketing on behalf of Sydney Fringe Tickets ABN 16 393 987 277 the 'Event Organiser'. Any and all issues or claims relating to sale and/or purchase of tickets and the provision of associated event(s) are the sole responsibility of the Event Organiser and Ferve Tickets (or any subsidiaries, affiliates, officers, agents, directors or employees) have no liability for any claims. Ferve Tickets is not liable for any loss or damage arising from the purchase of this ticket. Ferve Tickets cannot exchange or refund this ticket nor associated fees, please contact the Event Organiser with any queries. Ferve Tickets has no obligation to provide a refund or any other financial compensation if an event is cancelled, postponed or substantially altered by the Event Organiser, in which case you should contact the Event Organiser directly. Purchasing tickets constitutes your acceptance of this agreement.
